Terms of Use

These Terms of Use (the “Terms”) are a legal agreement between you and Periwell governing your use of the Periwell mobile application and the periwell.app website (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Medical disclaimer

Periwell is a general wellness and educational tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Content and insights are for informational purposes only and are not a substitute for professional medical care. Always consult a qualified healthcare provider with questions about your health. 2. License

Subject to these Terms, Periwell grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or distribute the Service except as permitted by law.

3. Subscriptions, billing, and cancellation

Periwell offers an optional auto-renewing subscription (“Periwell Plus”) that unlocks premium features such as the clinician-ready Health Report and advanced pattern insights.

• Pricing and terms (including any free-trial length and the price per period) are shown on the purchase screen in the app before you buy.
• Free trial. If a free trial is offered, your subscription begins and you will be charged the disclosed price when the trial ends, unless you cancel at least 24 hours before the trial period ends.
• Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Billing.Payment is charged to your Apple ID account at confirmation of purchase. Manage and cancel your subscription anytime in your device's App Store account settings.
• Refunds.Purchases are handled by Apple and are subject to Apple's refund policies; we generally cannot issue refunds directly.

4. Acceptable use

You agree not to use the Service to:

• violate any law or the rights of others;
• interfere with, disrupt, or attempt to gain unauthorized access to the Service;
• upload malicious code or attempt to circumvent security or usage limits.

5. Your content

Health data and notes you enter are stored on your device and remain yours. You are responsible for the information you enter and for keeping your own backups where needed. See our Privacy Policy for how data is handled.

6. Intellectual property

The Service, including its software, design, text, and graphics, is owned by Periwell and protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

7. Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, Periwell will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service.

8. Changes to the Service or these Terms

We may modify or discontinue features, and we may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the app. Your continued use after changes take effect constitutes acceptance.

9. Governing law

These Terms are governed by the laws applicable at Periwell's principal place of business, without regard to conflict-of-laws rules, except where local consumer-protection law provides otherwise.

10. Apple App Store

The following applies if you obtained the app from the Apple App Store:

• These Terms are between you and Periwell only, not with Apple. Apple is not responsible for the app or its content.
• Your license is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
• Periwell, not Apple, is solely responsible for the app and for providing any maintenance and support, and for addressing any claims relating to the app (including product liability, legal/regulatory compliance, and intellectual-property claims) to the extent required by law.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
